What Is A Separation?

In a separation, the parties remain married. However, they may agree upon a contract that provides for them to live separately and share expenses. Both must agree. If they do, the judge may consider approving a written agreement, which is a contract between them to share property, debt and expenses. If the contract is objectively fair and reasonable, the court may approve the arrangement and enter an order binding the parties. While the process accounts for all issues as would be settled in a divorce, if either spouse wants to convert the agreement to a formal divorce, they may file for divorce

Separation Vs. Divorce

Divorce formally terminates a marriage. Separation does not. Should a religious practice prohibit a divorce, or should a married couple wish to formally separate while attempting a reconciliation, a separation agreement may be preferable.
